Terms and Conditions Watersports Training
Dear Customer,
We would like to thank you for your interest in the offerings of Watersports Training. We are delighted that you have chosen one of our offerings. To safeguard the mutual interests of the contracting parties, we have established the General Terms and Conditions. Please read them carefully before making a booking. If you have any questions or uncertainties, please do not hesitate to contact us.
1 - Scope of Application
The General Terms and Conditions of Watersports Training apply to all services provided by Watersports Training in accordance with the contract concluded between the parties, especially for participation in all activities (such as training) and events (events, team building, etc.).
The General Terms and Conditions of Watersports Training apply to both consumers and entrepreneurs, unless differentiation is made in the respective clause.
2 - Contractual Basis
By registering, which can be done verbally, in writing, or via email, the customer offers Watersports Training the conclusion of a contract based on the relevant event description or the received offer, along with all additional information in the booking documents and these General Terms and Conditions.
The contract is concluded when accepted by Watersports Training. Acceptance must be in written form. The customer will receive a booking confirmation.
3 - Performance Obligation
Watersports Training's performance obligation is exclusively determined by the content of the booking confirmation, subject to all instructions and explanations contained therein.
Brochure information does not have contractual binding effect.
Agreements with our employees that alter or expand the scope of our contractual services require our written confirmation to be effective.
4 - Payment Method and Deadlines
1. Payment is made by bank transfer or credit card to Watersports Training S.L. and their accounts.
2. An advance payment of 30% of the contractually agreed service price is due after contract signing/booking confirmation. The customer will receive an advance payment invoice with the booking confirmation.
3. The remaining amount of the agreed total cost is to be paid in full upon invoicing by Watersports Training or on the agreed payment date.
4. The customer is in default of payment at the latest if payment is not made within 30 days of the due date and receipt of an invoice or equivalent payment statement. In relation to customers who are not consumers, Watersports Training is entitled to claim default interest at a rate of 8 percentage points above the base interest rate. Otherwise, a default interest rate of 5 percentage points above the base interest rate applies.
5 - Price and Performance Changes
1. Changes and deviations from the agreed contract content that become necessary after the contract is concluded and are not brought about in bad faith by Watersports Training are only permitted if the changes or deviations are not significant, do not lead to a substantial change in the contract performance, and do not affect the overall nature of the booking.
2. Any warranty claims remain unaffected if the altered services are defective.
3. Watersports Training reserves the right to change the advertised and confirmed price in the event of an increase in transportation costs and fees for certain services, to the extent that the increase affects the price per person, provided that more than 3 months pass between the customer's receipt of the booking confirmation and the agreed performance date.
4. In the event of a subsequent price change, Watersports Training must inform the customer without delay, at the latest 21 days before the performance date. Price increases after this point are not permitted.
6 - Cancellation of the Contract
The customer can withdraw from the contract at any time. It is recommended that the customer declares the withdrawal in writing. It is expressly pointed out that non-use of the service without an explicit declaration of withdrawal does not constitute withdrawal from the contract. In this case, the customer remains obliged to pay the full participant price.
Up to 3 months before the start of the event/service, the contract can still be canceled free of charge. After that, 100% of the travel price is due if the reserved place cannot be resold to another customer.
Watersports Training reserves the right to charge a higher compensation in individual cases, in line with the specific, quantifiable, and documented costs incurred by them, to the customer.
